Membership and Terms of Use
General Terms of Use of the Site, General Rules and Legal Responsibilities Related to It
It is recommended that you read the User Agreement, which includes the terms, rules and legal responsibilities specified below, before using ewela.co (www.ewela.co). If the specified terms are not suitable for you, please do not use the ewela.co site. By using the site and filling out the forms containing your personal information, you are deemed to have accepted the terms written on these pages.
JONGLOR reserves the right to update the content of this legal disclaimer page at any time and recommends its users to visit the legal disclaimer page every time they enter the site.
- Usage and Security Rules
ewela.co is open to all members. The services provided on the site are free unless otherwise stated.
In the following cases, the site administration may block the member’s use of the site and reserves its legal rights against the person or persons involved in the following initiatives:
1.a. Recording on the site information that is incorrect, irregular, incomplete and misleading, contains statements that are not in accordance with general morality, and is contrary to the laws of the Republic of Turkey.
1.b. Copying the site content partially or completely without permission.
1.c. The User is directly responsible for any damages that may arise from the sharing of the usage rights of information such as username and password given to the User or determined by them with third parties or organizations (use of this information by persons other than the User). Similarly, the User cannot use personal information such as IP address, e-mail address, username belonging to someone else on the Internet, nor can the User access or use the private information of other users without permission. The User is deemed to have accepted any legal and criminal liability that may arise from such use.
1.d. Using software that will threaten the security of the site, prevent the site and the software used from working, performing activities, attempting to perform activities, and obtaining, deleting or changing information.
- Content Usage
2.a. The visual and written content presented on ewela.co is for personal use. ewela.co is the owner or licensee of all materials (“Materials”) and related intellectual and industrial property rights, including all domain names, logos, icons, demonstrative, written, electronic, graphic or machine-readable technical data, applied sales system, business method and business model included in the content, and they are under legal protection. Unless otherwise stated, they cannot be used for commercial or personal purposes without permission or without indicating the source. It is prohibited to publish any element on this site in another medium or website or to provide a link without the permission of JONGLOR.
2.b. The software used in the design of these pages and the creation of the database belongs to JONGLOR. Copying or using the said software is strictly prohibited.
2.c. All criticisms sent to ewela.co belong to JONGLOR and may be used by JONGLOR for marketing purposes if desired.
- Responsibilities
3a. Information about users visiting ewela.co (visit duration, time, viewed pages) is tracked in order to provide them with better service. For detailed explanations and implementation on this matter, please see the KVKK Text at www.ewela.co/kisisel-verilerin-korunmasi
3.b. After the ewela.co user completes the required sections for registration and confirms his/her registration, he/she can start using the ewela.co site by entering his/her e-mail address and password, provided that he/she complies with the terms set forth in this agreement.
3.c. While using the ewela.co website and services, the User agrees to comply with the Turkish Penal Code, the Turkish Commercial Code, the Law on Intellectual and Artistic Works, the Decree Laws and legal regulations regarding the Protection of Trademark and Patent Rights, the Code of Obligations, other relevant legislation provisions and all kinds of announcements and notifications that ewela.co will publish regarding its services. All legal, penal and financial liabilities that may arise due to use contrary to these notifications and laws belong to the User.
3.d. If it is determined that the User does not comply with the obligations set forth in this agreement or the general rules stated on the ewela.co website, the User may be prevented from using ewela.co temporarily or indefinitely by JONGLOR and/or his/her account may be closed.
3.e. The user cannot take any action that prevents or hinders other users and visitors from using ewela.co, cannot install automatic programs and force/lock the servers or databases. Cannot attempt to cheat. In the event of such a move, the user accepts that their membership will be terminated and that they accept all legal and criminal liability that may arise from the situation.
3.f. It is the responsibility of the person to back up the messages made with ewela.co and is recommended by JONGLOR. JONGLOR cannot be held responsible for the loss, deletion or damage of the messages due to not backing up the messages.
3.g. The user cannot delete or remove any Copyright, Trademark and any Intellectual and Artistic Works Law notes on any material copied or printed from ewela.co.
3.h. Membership cancellation and account deletion can be done by the user by notifying the ewela.co site management. The user who terminates his/her membership will have his/her access authorization to the site revoked. The person who cancels his/her membership accepts that this process is irreversible.
3.i. The legislation on the Protection of Personal Data and the provisions in the link www.ewela.co/kisisel-verilerin-korunmasi shall apply regarding the deletion of any records belonging to the user account terminated by ewela.co or the user himself. The user cannot claim any rights or compensation regarding the deleted records.
3.j. The relationships between site users and each other or third parties are the responsibility of the individuals.
3.k. ewela.co may contain links or references to other websites that are not under its control. JONGLOR is not responsible for the content of these sites or other links they contain.
3.l. JONGLOR shall apply the provisions of the legislation on the Protection of Personal Data and the provisions of the link www.ewela.co/kisisel-verilerin-korunmasi to all information connected to your user account, provided that it complies with the terms of use, privacy principles and applicable legal regulations.
3.m. Different rules and obligations specific to that section may be specified in certain parts of the site. Individuals and organizations using these sections are deemed to have accepted these rules in advance.
3.n. The User accepts and undertakes that the payment information (credit card, GSM number information, etc.) he/she will use in the purchases he/she will make through the site is correct and that he/she will be responsible for any legal and criminal liabilities arising from these.
3.o. The User accepts that he/she will be deemed to have accepted all the provisions of this participation agreement from the moment he/she starts to benefit from the service and that the agreement will be valid for him/her. The User agrees to compensate in kind any damages that JONGLOR may suffer due to his/her actions contrary to the obligations he/she has assumed with this agreement. JONGLOR has the right to recourse in kind to the User for any compensation and/or administrative/judicial fines that he/she may have to pay to public institutions and/or third parties due to the User’s actions contrary to the agreement.
- JONGLOR’s Rights and Obligations
4.a. JONGLOR shall allow the user to benefit from the services subject to the contract, except for technical malfunctions. In case the user is found to have caused any electronic sabotage, attempts to interfere with earnings and/or attacks that will prevent the operation of the ewela.co website, or if official authorities file a criminal complaint or request for official investigation against the member and/or in cases specified in the Law on the Protection of Personal Data, relevant legal regulations and the link www.ewela.co/kisisel-verilerin-korunmasi, ewela.co has the right to investigate and disclose the identity information of the relevant member.
4.b. JONGLOR may make unilateral changes to this agreement without any notification in order to ensure the continuity of the services it undertakes. JONGLOR has the right to permanently or temporarily stop the service it provides unilaterally at any time without giving any reason, to change the content of the service or to cancel it. The user accepts this right. In case of any changes, JONGLOR will publish the current terms of use on its website under the same link and, if deemed necessary, will notify its users by e-mail. The renewed current terms of use will be valid from the moment they are published on ewela.co and the use of the ewela.co website or services will be subject to the renewed terms of use from that moment on.
4.c. The membership of the member who has sent materials to ewela.co site that are contrary to the provisions of this agreement may be terminated unilaterally by JONGLOR without any notice.
- Entry into Force of the Agreement
5.a. The user is deemed to have undertaken to comply with the ewela.co agreement from the moment he/she fills out and approves the registration form or receives any service or places an order using this system. The agreement will automatically become null and void without any warning upon termination of membership or the occurrence of any of the termination conditions listed in this agreement.
- Jurisdiction and Dispute Resolution
6.a. Istanbul Anatolian Courts and Enforcement Offices are authorized to resolve disputes that may arise from the implementation of this contract.
- Notification Addresses
7.a. ewela.co does not request mailing addresses from its users in advance. However, the e-mail address provided by the user to ewela.co is accepted as the e-mail address to which the legal address will be requested for all kinds of notifications to be made in relation to this agreement.
7.b. The parties agree that unless they notify the other party in writing of any changes to their current e-mail addresses within 3 (three) days, requests made to old e-mail addresses will be valid and will be deemed to have been made to them.
7.c. Again, any notification made by ewela.co using the registered e-mail address of the user will be deemed to have reached the user 1 (one) day after the e-mail is sent by ewela.co. The user declares, accepts and undertakes that he/she has read, understood and accepted all the articles in this participation agreement and that he/she confirms the accuracy of the information he/she has provided about himself/herself.
